dc.description.abstract Since the 1970s, victims' rights groups have successfully attained changes in both state and federal law intended to give crime victims a greater role in prosecutions. These efforts culminated in what can be considered the "most prominent and controversial among these measures...the advent of 'victim impact evidence' in criminal trials." The strength of the victims' rights movement and modern political pressures make it highly unlikely that legislators will enact laws placing limitations on the type of VIE that may be presented during capital sentencing hearing. Therefore, it lies with the Court to "provide the lower courts with long-overdue guidance on the scope of admissible victim impact evidence." Considering the prejudicial effects that such emotionally charged evidence can have on a sympathetic jury, courts should closely monitor VIE and limit it to the evidence that is most relevant to the crime for which the defendant is being sentenced.
