Abstract:
This policy development guide was developed by American Probation and Parole Association with funding from the Bureau of Justice Assistance to address the problem of sexual abuse in tribal detention facilities....The guide is presented in four sections. (CVRL Note: first two sections summarize research on sexual assault in jails and in Indian country.) The first section discusses the Prison Rape Elimination Act (PREA) and its implications for correctional facilities in Indian Country. Section two examines the problem of corrections-based sexual assault and the impact of sexual abuse victimization on inmate behavior. The third section examines ways in which existing policies can be revised and improved to prevent and address the problem of corrections-based sexual abuse. The final section of the guide includes guidelines for developing policy that would implement the PREA in tribal correctional facilities. The guidelines include prevention planning, responsive planning, training and education, screening for risk of sexual victimization and abusiveness, reporting on sexual abuse incidents, the official response to an inmate report, investigations of alleged instances of abuse, discipline, the availability of medical and mental care, and data collection and review regarding the facilities handling of the problem.
